1. Who we are, and what The Herbarium is

The Herbarium is a private tasting journal and educational strain encyclopedia for adults. It lets you record your own observations and browse curated, aggregate information about cannabis cultivars. It is operated by a sole trader based in Malta ("we", "us"). You can reach us at theherbarium.beta@gmail.com.

The Herbarium does not sell, supply, advertise the sale of, or facilitate the purchase of cannabis or any other controlled substance. The only thing sold through the app is the software subscription described in section 6.

2. Age and legality

3. Educational content, not medical advice

All archive content, including descriptions, terpene profiles, aroma and flavour notes, associations and suggestions, describes sensory character only. It is educational, it is never a promise about what a product will do, and it is not medical, health, or therapeutic advice. Speak to a qualified professional about health questions. Actual product chemistry varies by batch; the lab report on the product you hold is the only source of truth.

7. Acceptable use

Don't attempt to break, misuse, or reverse the app or its access controls; don't use it to store unlawful content; don't resell or redistribute the archive's content. The strain archive is curated editorial content and may not be scraped or republished without written consent. We may suspend or close an account that breaks these terms; where the law requires it, we will warn you first.

8. No warranty; limitation of liability

The app is provided "as is", without warranties of any kind. To the fullest extent permitted by law, The Herbarium and its operator are not liable for indirect or consequential damages, for loss of data you chose not to back up, or for decisions you make based on the app's content. Nothing in these terms limits liability that cannot lawfully be limited, including liability under mandatory EU consumer protection rules.

9. Changes to these terms

We may update these terms as the product evolves. Material changes will be flagged in the app before they take effect, and for subscribers we will give reasonable advance notice. Continued use after changes take effect means you accept the updated terms; if you do not accept them, stop using the app and, if you subscribe, cancel before the change applies.

10. Governing law

These terms are governed by the laws of Malta. If you are a consumer in the EU, this does not take away protections you hold under the mandatory consumer law of the country where you live, and you may bring claims before your home courts where EU law provides for that. You can also use the dispute resolution options available to consumers in your country.
