Terms of Use
1. Who we are, and what The Herbarium is
The Herbarium is a private tasting journal and educational strain encyclopedia for adults. It lets you record your own observations and browse curated, aggregate information about cannabis cultivars. It is operated by a sole trader based in Malta ("we", "us"). You can reach us at theherbarium.beta@gmail.com.
The Herbarium does not sell, supply, advertise the sale of, or facilitate the purchase of cannabis or any other controlled substance. The only thing sold through the app is the software subscription described in section 6.
2. Age and legality
- You must be at least 18 years old, or the higher legal age that applies where you live, to use the app. The app asks you to confirm this before entry and records the date of your confirmation on your device.
- You are responsible for knowing and following the laws of your jurisdiction. The Herbarium is an informational journal; possession and consumption laws differ by country and region, and nothing in the app is an encouragement to consume.
3. Educational content, not medical advice
All archive content, including descriptions, terpene profiles, aroma and flavour notes, associations and suggestions, describes sensory character only. It is educational, it is never a promise about what a product will do, and it is not medical, health, or therapeutic advice. Speak to a qualified professional about health questions. Actual product chemistry varies by batch; the lab report on the product you hold is the only source of truth.
4. Your account (optional)
- The app works fully without an account, including offline. An account is optional and exists for two things: carrying your collection between devices, and holding a paid subscription.
- Sign-in works by email link. You give us your email address, we send a one-tap sign-in link, and there is no password. Keep control of your email inbox: anyone who can read your email can sign in to your account.
- You must give a valid email address that is yours, and you may not access another person's account.
- You can sign out at any time from Profile, and you can ask us to delete your account (see section 5).
5. Your data, journal, and sync
- Your entries are yours. We claim no ownership over what you write.
- Signed out, everything you record is stored only on your device. If your device or browser storage is cleared, that data is gone; use the built-in backup export in Profile.
- Signed in, the app keeps a copy of your journal and collection on our servers so it can follow you across devices. Photos and your app PIN are never uploaded; they stay on the device where you created them. The privacy policy lists exactly what syncs and what does not.
- You can export your data at any time as a plain or encrypted backup. The encrypted backup is protected by a passphrase you choose; we cannot recover that passphrase or open the file without it. That is by design. If you lose the passphrase, the encrypted backup is unreadable.
- Deleting your account removes the server copy of your data. It does not touch the copy on your devices, and clearing a device does not touch the server copy. Each has to be removed where it lives.
- Do not use the app to store unlawful content.
6. Plans, payment, and cancellation
- The free plan includes a limited number of journal entries and vault specimens; the limits are shown in the app. Content you have already created never becomes inaccessible if you stop paying; limits only apply to adding new content.
- Herbarium Premium is a paid subscription, billed monthly or yearly. Prices are shown in the app and at checkout, and include VAT where applicable, calculated for your country at checkout.
- Payment is processed by Stripe through Stripe Checkout. Your card details go directly to Stripe and never pass through us; see the privacy policy. A subscription requires an account, because the subscription belongs to the account, not to a device.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can manage or cancel at any time through the billing portal, reached from Profile. Cancelling stops future renewals; Premium remains active until the end of the period already paid for.
- If you subscribe as an EU consumer you have a 14 day right of withdrawal from the date of purchase. If you ask for Premium to start immediately and it does, you may still withdraw within those 14 days; any refund may be reduced in proportion to the service already supplied, as EU consumer law allows. To withdraw, use the billing portal or email us.
- Some accounts hold Premium through a launch licence code rather than a paid subscription. Those grants follow the terms stated when the code was issued and are not billed.
- If we change prices, the new price applies from your next renewal at the earliest, and we will tell you in advance so you can cancel first.
7. Acceptable use
Don't attempt to break, misuse, or reverse the app or its access controls; don't use it to store unlawful content; don't resell or redistribute the archive's content. The strain archive is curated editorial content and may not be scraped or republished without written consent. We may suspend or close an account that breaks these terms; where the law requires it, we will warn you first.
8. No warranty; limitation of liability
The app is provided "as is", without warranties of any kind. To the fullest extent permitted by law, The Herbarium and its operator are not liable for indirect or consequential damages, for loss of data you chose not to back up, or for decisions you make based on the app's content. Nothing in these terms limits liability that cannot lawfully be limited, including liability under mandatory EU consumer protection rules.
9. Changes to these terms
We may update these terms as the product evolves. Material changes will be flagged in the app before they take effect, and for subscribers we will give reasonable advance notice. Continued use after changes take effect means you accept the updated terms; if you do not accept them, stop using the app and, if you subscribe, cancel before the change applies.
10. Governing law
These terms are governed by the laws of Malta. If you are a consumer in the EU, this does not take away protections you hold under the mandatory consumer law of the country where you live, and you may bring claims before your home courts where EU law provides for that. You can also use the dispute resolution options available to consumers in your country.
